Terms and Conditions

1. Scope and Provider
These Terms and Conditions apply to all orders placed through the VERNET online store (vernet.clo), operated by Justin Friesen, Lauffener Straße 8, 78628 Rottweil, Germany ("we," "us"), trading under the registered business name "wearhisword."

2. Conclusion of Contract
Product listings on this store do not constitute a binding offer on our part, but an invitation to order. By placing an order, you submit a binding offer to purchase. We will confirm receipt of your order by email; this confirmation does not yet constitute acceptance of your offer. A contract is formed only when we explicitly confirm the order or ship the goods.

3. Preorder Model
Products in Drop 01 are sold on a preorder basis. Your payment is charged at the time of order. Production begins once a minimum threshold of preorders is reached, as communicated on the product page. Estimated shipping timelines are provided in good faith but are not guaranteed delivery dates, given the dependency on the production threshold and manufacturing lead time in Portugal.

4. Prices and Payment
All prices are shown in EUR. As a small business under § 19 UStG, no VAT is added to or shown on prices. Accepted payment methods are displayed at checkout. Payment is due immediately upon order placement.

5. Shipping
Shipping costs and estimated timelines are shown at checkout. Risk of loss passes to the consumer upon delivery of the goods.

6. Right of Withdrawal
Consumers have a statutory right of withdrawal as described in our separate Right of Withdrawal policy.

7. Warranty
Statutory warranty rights apply. Consumers are entitled to the legal warranty rights for defects (§§ 434 ff. BGB).

8. Liability
We are liable without limitation for damages arising from injury to life, body, or health, and for damages caused by intent or gross negligence. For damages caused by ordinary negligence, we are liable only for the breach of material contractual obligations ("Kardinalpflichten"), and liability is limited to foreseeable, typically occurring damage.

9. Applicable Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law does not deprive you of protections granted by mandatory provisions of the law of your habitual residence.

10. Final Provisions
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
